PokerGO (“Sponsor”) is pleased to introduce the PokerGO Shop Gift Card Giveaway (“Giveaway”). As a condition of participating in the Giveaway, you agree to be fully and unconditionally bound by these Official Rules and the decisions of Sponsor, whose decisions shall be final and binding in all respects, and, to the fullest extent provided by law, waive any right to claim ambiguity in the Giveaway, Giveaway materials, and these Official Rules, as made available at giveaway.pokergo.com. The Giveaway is subject to applicable federal, state, and local laws and regulations and is VOID WHERE PROHIBITED OR RESTRICTED BY LAW. Winning and receiving a prize is contingent upon fulfilling all requirements set forth herein.

1. SOCIAL NETWORKING SITE DISCLAIMERS

As a condition of participating in the Giveaway, you agree and acknowledge that social networking sites used to promote the Giveaway (e.g., Facebook, Twitter, Instagram) as well as their owners, directors, officers, employees, contractors, agents, representatives, parents, subsidiaries, attorneys, insurers, and associated entities (collectively, the “Social Media Group”) are not sponsors of the Giveaway, do not endorse or administer the Giveaway, and are not in any way associated with the Giveaway. All questions regarding the Giveaway must be directed to Sponsor, not the Social Media Group. You also agree that as a condition of participating in the Giveaway, you shall release the Social Media Group from any and all liability arising out of or relating to your entry, creation of an entry or submission of an entry, participation in the Giveaway, acceptance, use, or misuse of any prize, or the broadcast, exploitation, or use of an entry.

2. ELIGIBILITY

The Giveaway is open only to citizens and permanent legal residents of the United States of America and any other jurisdiction in which the Giveaway is legal that are physically located and residing therein who (i) are at least twenty-one (21) years of age at the time of entry; (ii) are not barred from participation in the Giveaway under the laws of the jurisdiction of their residence including but not limited to all federal, state, and local laws; and (iii) at all times abide by these Official Rules. THE GIVEAWAY IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW. ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS APPLY.

Officers, directors, members, managers, employees, representatives, and agents of Sponsor and each of their respective parent companies, affiliates, subsidiaries, franchisees, prize providers, fulfillment agencies, and any other companies associated with the design or execution of the Giveaway, including Immediate Family Members (as defined below) and Household Members (as defined below) for each of the aforementioned are not eligible to participate in or win the Giveaway. “Immediate Family Members” shall mean spouse, parents, step-parents, legal guardians, children, step-children, siblings or step-siblings and each of their spouses regardless of where they reside. “Household Members” shall mean those people who share the same residence at least three (3) months a year.

3. GIVEAWAY PERIOD

The Giveaway begins on May 30, 2023, at 9:00:00 am Pacific Time (“PT”) and ends on July 17, 2023, at 2:00:00 pm PT (“Giveaway Period”). PT shall control for all purposes of the Giveaway.

4. HOW TO ENTER

NO PURCHASE OR PAYMENT OF ANY KIND IS REQUIRED TO ENTER. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING.

During the Giveaway Period, eligible individuals may submit entries into the Giveaway, as follows:

A) Share on Social Media
Visit the PokerGO table located in the event center where the main stage and feature tables are located at the Horseshoe Las Vegas in Las Vegas, Nevada (“PokerGO Table”).
Enter the Giveaway by taking a picture that features the PokerGO Table and posting the picture to your Facebook, Tik Tok, Instagram or Twitter account using the hashtag “#WSOPonPokerGO” (each a “Social Post”). Only Social Posts that are viewable to Sponsor and the public and do not include derogatory language or references are eligible for the Giveaway.
Eligible individuals may post as many Social Posts as they wish, with each Social Post being eligible for the drawing(s) and increasing the entrant’s chance of winning a prize, however, an entrant is only eligible to win one (1) of the prizes stated below.
Social Posts must be posted to your Facebook, Tik Tok, Instagram or Twitter at the time of a drawing in order to be eligible for that particular drawing.
B) Alternative Method of Entry (“AMOE”)
Send a postcard or letter to: PokerGO, 3993 Howard Hughes Pkwy., Suite 450, Las Vegas, Nevada 89169, Attn: PokerGO Shop Gift Card Giveaway.
Include the following on the postcard or letter (please print legibly – illegible entries will be discarded):
1. Full name, email address, mailing address, and phone number;
2. A statement that you (i) wish to enter the PokerGO Shop Gift Card Giveaway; (ii) meet the eligibility requirements in the Official Rules; and (iii) agree to all Official Rules; and
3. Your signature under the above statement and information.
Only one AMOE entry is permitted per person. Each AMOE entry is entitled to one entry into the drawing(s).
AMOE entries must be received by 11:59:59pm PT on the Thursday immediately preceding a drawing in order to be eligible for that particular drawing.

5. ENTRY CONDITIONS

Social Posts generated by a script, computer programs, macro-programmed, robotic or any other automated means are void and may be disqualified at Sponsor’s sole discretion. Social Posts that are incomplete, incorrect, illegible, corrupted, damaged, destroyed, forged, false, lost, late, misdirected, deceptive, or are otherwise not in compliance with the Official Rules are also void and may be disqualified from the Giveaway at Sponsor’s sole discretion. Sponsor will not be responsible for invalid submissions and has no obligation to advise an individual of such a submission. If a problem occurs in the entry process, the entrant is solely responsible for verifying that the entry process has been validly completed.

Entries received after the Giveaway Period will not be included in the Giveaway. Screen shots, printouts or other purported "proof" or "evidence" of entry or winning, in lieu of Sponsor's validation process, shall not be binding. Proof of sending (such as an automated receipt, screen shots, etc.) does not constitute proof of actual receipt of an entry for purposes of these Official Rules.

In the event of any dispute as to the identity of any entrant, Sponsor may require proof of identity and residency such as a driver’s license, passport, and/or utility bills, and proof of eligibility. Sponsor’s determination of eligibility will be final.

6. DRAWINGS AND PRIZES

Subject to verification of eligibility and compliance with these Official Rules, the following prize awards will be available to eligible entrants participating in the Giveaway:

The Giveaway will consist of seven (7) drawings, as listed above. Each drawing will consist of: (a) all eligible Social Posts published, during the Giveaway Period, to Facebook, Tik Tok, Twitter or Instagram as of the date of the applicable drawing, and (b) all eligible entries received, during the Giveaway Period, via AMOE as of 11:59:59pm PT on the Thursday immediately preceding the applicable drawing. For each drawing, Sponsor will randomly select one (1) winner from all such eligible entries to win the prize stated above (i.e., one prize per drawing). All eligible entries that were not selected in a particular drawing (excluding the final drawing) will be automatically included in the subsequent drawing(s) however, a prize winner is not eligible to win subsequent drawings in this Giveaway.

The total ARV of all prizes that could be awarded in the Giveaway is $700. The prize will be awarded only if the prize winner fully complies with these Official Rules. All prize details are at the sole discretion of Sponsor and any depiction of the prize, in Giveaway materials or otherwise, is for illustrative purposes only. The prize is non-transferable, non-exchangeable, non-refundable, may not be redeemed for a cash alternative, and must be accepted by the winner as awarded. A prize winner may waive their right to receive a prize. Sponsor shall have no responsibility or obligation to a prize winner or a prize winner who is unable or unavailable to, or who does not for any reason, accept or utilize a prize. In the event of non-compliance with these Official Rules by a prize winner, or if a prize is unclaimed, that prize will be forfeited. A forfeited prize may be awarded to an alternate winner, in Sponsor's sole discretion.

All federal, state, and local taxes, and all costs and expenses related to the acceptance and use of a prize not specified herein, are the sole responsibility of the prize winner. Any required tax reporting forms will be furnished to the appropriate authorities.

7. WINNER NOTIFICATION AND VERIFICATION

Sponsor will attempt to notify a winner within seven (7) days after the drawing date using, in the case of a Social Post entry, the messaging features of the social media platform associated with the applicable Social Post, or in the case of a AMOE entry, the email address submitted with their entry. Sponsor may, at its discretion, also attempt to contact a winner by any other means of contact provided by the entrant. If a winner cannot be contacted or does not respond to Sponsor within seventy-two (72) hours of Sponsor’s initial notification, the winner may be disqualified at Sponsor’s sole discretion.

A winner must provide Sponsor with the information required to verify the winner’s eligibility to participate in this Giveaway and file any necessary tax reporting forms, including but not limited to, winner’s country of residence, mailing address, Social Security number or tax ID for tax reporting purposes. A winner must also provide accurate contact information to Sponsor to enable necessary communications for coordination and fulfillment of the prize, and must provide Sponsor with a written statement that they meet the eligibility requirements in the Official Rules and agree to all Official Rules. Except where prohibited by law, a winner also may be required to sign and return to Sponsor, within five (5) business days from the date when Sponsor’s initial notification was sent, a declaration of eligibility and liability/publicity release (“Declaration”) via email to the address specified in the Declaration in order to claim their prize. If the Declaration is returned as undeliverable or incomplete or a winner fails to complete, sign and return the applicable Declaration within the required time period, or the winner does not adhere to the Official Rules, including without limitation, the winner does not fulfill the eligibility requirements, the winner may be disqualified at Sponsor’s sole discretion.

In the event a winner is disqualified for any reason, or if a prize is unclaimed or not accepted, the prize will be forfeited. If forfeited for any reason, the winner will not receive any other prize substitution or compensation, and the prize will remain the property of Sponsor and will not be awarded unless Sponsor, at its sole discretion, decides to award the forfeited prize to an alternate winner.If Sponsor decides to select an alternate winner for a prize, the alternate winner will be randomly selected from the pool of eligible entries as of the date of the drawing. If an alternate winner cannot be contacted or does not respond to Sponsor within seventy-two (72) hours of Sponsor’s initial notification, the alternate winner may be disqualified at Sponsor’s sole discretion. Sponsor retains the right to repeat this process until an alternate winner complies with the verification of eligibility requirements.

ALL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR. SPONSOR’S DECISIONS AS TO THE ADMINISTRATION AND OPERATION OF THE GIVEAWAY, ANY CHANGES TO THESE OFFICIAL RULES, AND THE SELECTION OF WINNERS IS FINAL AND BINDING IN ALL MATTERS RELATED TO THE GIVEAWAY. ALL REFERENCES TO A “WINNER” IN THESE OFFICIAL RULES SHALL BE INTERPRETED AS A POTENTIAL WINNER CONDITIONED UPON SUCH WINNER’S ACCEPTANCE OF, AND COMPLIANCE WITH, THESE OFFICIAL RULES.

8. ODDS OF WINNING

The odds of winning a prize in a particular drawing depend on the number of entries. The estimated odds of winning a prize in a particular drawing are 1:500.

9. RIGHTS OF PUBLICITY

Except where prohibited by law, by participating in this Giveaway or accepting a prize, entrants grant Sponsor and its designees the right to use and/or publish the entrant’s Social Post, full name, city and state of residence, photographs or other likenesses, pictures, portraits, video, voice, testimonials, biographical information (in whole or in part), and/or statements made by the entrant regarding the Giveaway or Sponsor, worldwide and in perpetuity for any and all purposes, including, but not limited to, advertising, trade and/or promotion on behalf of Sponsor in any and all forms of media, now known or hereafter devised, including, but not limited to, print, TV, radio, electronic, cable, or World Wide Web, without further limitation, restriction, compensation, notice, review, or approval.

ENTRANT FURTHER ACKNOWLEDGES THAT THEIR PERSONAL IDENTIFYING INFORMATION MAY BE DISCLOSED TO THIRD PARTIES INCLUDING, WITHOUT LIMITATION, PLACING THEIR NAME ON A WINNER’S LIST.

10. GENERAL CONDITIONS

Winning a prize is contingent upon accepting these Official Rules and fulfilling all requirements of these Official Rules. Sponsor reserves the right without liability to disqualify any entrant or cancel, suspend, modify, and/or terminate the Giveaway, or any part of it, for any reason, including, but not limited to, insufficient entries in the Giveaway, postponement or cancellation of a particular event, any printing, seeding, typographical, technical errors, human or otherwise, suspected or actual evidence of electronic or non-electronic tampering with any portion of the Giveaway, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Giveaway or any other factor beyond Sponsor’s reasonable control, as determined by Sponsor at its sole discretion. In such event, Sponsor reserves the right but not the obligation to award the prize to the extent required by law for eligible entries submitted up to the time of the impairment (and/or thereafter), or in such other manner as deemed fair and appropriate by Sponsor at its sole discretion. Sponsor also reserves the right to disqualify any individual it finds to be tampering or interfering with the operation of the Giveaway or acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner.

ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK CIVIL AND/OR CRIMINAL PROSECUTION AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM OR AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor's failure to enforce any term of these Official Rules will not constitute a waiver of that provision. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the Official Rules or any provision hereof.

11. RELEASE AND LIMITATION OF LIABILITY

By participating, the entrant agrees to release, indemnify, defend, and hold harmless Sponsor, the Social Media Group, and Caesars Interactive Entertainment, LLC, and each of their respective officers, directors, members, managers, employees, representatives, agents, successors and assigns (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability of any kind resulting or arising from the Giveaway (including reasonable attorneys’ fees), including, but not limited to, negligence and damages of any kind to persons and property, invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or any other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright, or other intellectual property rights, property damage, or death or personal injury arising out of or relating to their entry, creation of an entry or submission of an entry, participation in the Giveaway, acceptance, use, or misuse of a prize, or the broadcast, exploitation, or use of an entry.

To the maximum extent permitted by law, the Released Parties are not responsible for: (i) any incorrect or inaccurate information, whether caused by entrants, technical errors, or by any of the equipment or programming associated with or utilized in the Giveaway; (ii) technical failures of any kind, including, without limitation, malfunctions, interruptions, or disconnections of the equipment or software associated with or utilized in the Giveaway; (iii) unauthorized human and/or mechanical intervention in any part of the entry process or the Giveaway; (iv) technical or human error which may occur in the administration of the Giveaway or the processing of entries; or (v) any injury or damage to persons or property including, without limitation, death, bodily injury, pain and suffering, emotional distress or loss of data which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Giveaway or receipt, use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, the entrant’s sole remedy is to submit another entry during the Giveaway Period through a method set forth in these Official Rules. Under no circumstances will the entrant be permitted to obtain awards for, and the entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for punitive, incidental or consequential damages, in which case the liability of the Released Parties will be limited to the maximum extent permitted by law. By participating, the entrant acknowledges and agrees that remedies for any breach of these Official Rules by the Released Parties are limited to an action at law for money damages, if any, and an entrant shall not be entitled to equitable relief.

12. PRIVACY

All entry information becomes the sole and exclusive property of Sponsor. Entrant agrees to Sponsor’s collection, use and disclosure of their personal information (including information derived from a postcard or letter entry) in accordance with its privacy policy, available at www.pokergo.com/privacy-policy. Please refer to each Social Media Group company’s respective privacy policy for important information regarding their collection, use and disclosure of personal information.

13. DISPUTES

By participating, entrant agrees that any and all disputes and claims arising out of or in connection with this Giveaway, or any prizes awarded, shall be resolved individually, without resort to any form of class or joint action. Entrant further agrees that if the dispute or claim is not otherwise resolved through direct discussions or mediation, it shall then be resolved by final and binding arbitration before a single arbitrator administered by Judicial Arbitration and Mediation Services, Inc., in accordance with its streamlined arbitration rules and procedures or subsequent versions thereof ("JAMS Rules"). Entrant waives any right to bring their dispute or claim in court. The JAMS Rules for selection of an arbitrator shall be followed. All proceedings brought pursuant to this paragraph will be conducted in Las Vegas, Nevada. Entrant further agrees that, to the fullest extent permitted by law, (i) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway, and in no event will entrant be entitled to receive attorneys’ fees or other legal costs; and (ii) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, special, indirect, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of you and Sponsor in connection with this Giveaway, shall be determined by the arbitrator and governed by, and construed in accordance with the laws of the State of Nevada, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Nevada or any other jurisdiction). By participating in the Giveaway, Entrant irrevocably waives all right to a jury trial and any right Entrant may have to join claims with those of others in the form of a class action or similar procedural device. Any disputes arising out of, relating to, or connected with the Giveaway must be asserted individually. The decision of the arbitrator may be entered into any court as necessary for enforcement. To the extent possible, the entrant agrees to keep the occurrence of, and specifics and pleadings related to, the arbitration confidential, and will request that any court action relating to entry of judgment on the arbitration award be conducted under seal.

14. EXTENDED MEANINGS; CURRENCY; FORCE MAJEURE

Unless otherwise specified in these Official Rules, words importing the singular include the plural and vice versa and words importing gender include all genders. All dollar amounts referred to in these Official Rules are in lawful money of the United States of America. The Released Parties are not responsible for any damages caused by delay or failure to perform undertakings pursuant to these Official Rules when the delay or failure is due to weather, event cancellations, fires, strikes, floods, acts of God or the state’s enemies, lawful acts of public authorities, epidemics/pandemics, delays or defaults caused by common carriers, or other events that cannot reasonably be foreseen or provided against.

15. OFFICIAL RULES AND WINNER’S LIST

These Official Rules are available at giveaway.pokergo.com. The Giveaway Winner’s List will be available upon request by sending a self-addressed stamped envelope to: PokerGO, 3993 Howard Hughes Pkwy., Suite 450, Las Vegas, Nevada 89169, Attn: PokerGO Shop Gift Card Giveaway Winner’s List. The Winner’s List will be available for at least three (3) months after the end of the Giveaway.
